1. Acceptance of Terms
By accessing or using PIPGURU (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
We reserve the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the effective date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
2. Service Description
PIPGURU is a web-based software application that helps hotel asset managers, franchise consultants, and hospitality professionals generate cost estimates for Property Improvement Plans (PIPs). The Service provides two estimation modes:
- Gut Check: A rapid estimation tool that produces a budget range based on renovation tier, room count, and section-level scope selections.
- Deep Dive: A detailed line-item estimation tool allowing granular control over quantities, unit costs, and allowances.
PIPGURU is a decision-support tool. It is not a substitute for professional construction cost estimating, contractor bids, or architectural review. All outputs are estimates and should be validated by qualified professionals before use in financial models or negotiations.
3. User Accounts
You must create an account to access the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete registration information
- Update your information to keep it accurate and current
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with any third party
We reserve the right to terminate accounts that violate these Terms, are inactive for extended periods, or are associated with fraudulent activity.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Scrape, crawl, or harvest data from the Service by automated means
- Attempt to reverse-engineer the cost data or pricing models underlying the Service
- Use the Service to build a competing product or service
- Transmit any viruses, malware, or harmful code
- Impersonate any person or entity, or falsely state your affiliation
- Use the Service for any unlawful or fraudulent purpose
5. Estimates & Accuracy
PIPGURU provides cost estimates based on aggregated market data, brand-specific historical data, and regional cost factors. These estimates are inherently approximate and carry a margin of error.
You acknowledge that:
- Actual costs may differ materially from PIPGURU estimates based on local market conditions, contractor availability, material costs, and project-specific factors
- PIPGURU estimates are not guarantees of actual project costs
- Estimates should not be used as the sole basis for financial decisions without independent verification
- PIPGURU LLC makes no warranty regarding the completeness or accuracy of any estimate
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of PIPGURU LLC and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
The cost guide data, pricing models, and estimation algorithms incorporated in the Service are proprietary and confidential. You may not copy, reproduce, distribute, or create derivative works based on this data.
7. Your Data
You retain ownership of all data you input into the Service, including estimate parameters, property information, and custom adjustments (“User Data”). By using the Service, you grant us a limited license to store, process, and display your User Data solely to provide the Service.
We may use aggregated, anonymized data derived from your usage to improve the Service, calibrate cost models, and generate industry benchmarks. This data will not identify you or your specific projects.
8. Payment & Billing
Certain features of the Service require a paid subscription. All fees are stated in US dollars and are exclusive of applicable taxes. Payment is due at the beginning of each billing period.
Subscriptions auto-renew unless cancelled before the renewal date. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time.
We reserve the right to modify pricing with 30 days advance notice. Continued use after a price change constitutes acceptance.
9. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or if we determine that continuation poses legal or security risks. Upon termination, your right to use the Service will immediately cease.
You may terminate your account at any time by contacting us at info@thepipguru.com. Following termination, we will retain your data for 90 days before permanent deletion, during which time you may export your estimates.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIPGURU LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
12. Indemnification
You agree to defend, indemnify, and hold harmless PIPGURU LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
13. Governing Law
These Terms shall be governed by the laws of the State of Maryland, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Maryland.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
